Non-Profit Organizations
Lanier Ford is experienced in creating and advising non-profit and charitable organizations, such as private foundations, churches, schools and colleges, business leagues, political parties, and country clubs. Although these organizations are typically tax exempt, a nonprofit or charitable organization may have to pay an unrelated business income tax (UBIT) on income from any business operations that don't advance the organization's tax-exempt purpose.
Our attorneys assist a non-profit organization in obtaining tax-exempt status. Thereafter, they advise these organizations on activities that may result in UBIT liability or loss of tax-exempt status. Our attorneys advise on the following and other related issues unique to nonprofit and charitable organizations:
- Record-keeping requirements.
- Organizational structure and management (governance).
- Limitations on legislative and political activities.
- Charitable deductions.
