Attorneys practicing in this area:

Lanier Ford’s litigation attorneys defend businesses and other clients against claims by consumers or other businesses alleging fraud in the sale of goods or services. Alabama law essentially recognizes two types of fraud: deliberate fraud (often called deceit) and negligent fraud (sometimes referred to as “legal fraud”).

Deceit is committed by deliberately or recklessly providing false information about a good or service or by deliberately withholding information that a person has a duty to reveal. Deceit can also be committed by deliberately concealing conditions (about a piece of real estate, for example). Negligent fraud is committed by mistakenly providing false information about a good or service.

An important aspect of fraud litigation is the potential award of punitive damages. Our attorneys are knowledgeable and skilled at defending against claims for punitive damages and minimizing or eliminating the award of such damages.
