A trademark or service mark is a word, name, symbol, or device used to identify and distinguish your products or services from those provided by another source. The rights in a trademark or service mark are created by its proper use in commerce. Although a mark can be registered under state law, it can also receive federal protection through registration with the U.S. Patent and Trademark Office. While registration offers important benefits, trademarks do not have to be registered to be protectable and to represent a property right.
