Alabama law essentially recognizes two types of fraud: deliberate fraud (often called deceit) and negligent fraud (sometimes referred to as “legal fraud”).
Deceit is committed by deliberately or recklessly providing false information about a good or service or by deliberately withholding information that a person has a duty to reveal. Deceit can also be committed by deliberately concealing conditions (about a piece of real estate, for example). Negligent fraud is committed by mistakenly providing false information about a good or service.
