Elena G. Moats

Elena’s practice focuses on commercial and civil litigation, construction law, real estate, eminent domain, and matters involving public entities and airport authorities.  She represents businesses, governmental entities, property owners, developers, contractors, professionals, and individuals in a wide range of litigation and business matters.

Elena handles complex commercial litigation, including contract disputes, business and real estate disputes, construction claims, insurance coverage matters, and other disputes arising from commercial relationships and transactions.  She represents clients in state and federal courts through all stages of litigation, from pre-suit evaluation and resolution efforts through discovery, dispositive motions, trial, and appeal.

As part of her construction practice, Elena advises owners, developers, homebuilders, contractors, and other project participants throughout the life cycle of public and private construction projects.  Her experience includes drafting and negotiating construction contracts, professional services agreements, work authorizations, procurement and purchasing agreements, and other project-related agreements, as well as advising clients regarding contract administration, project delivery, payment issues, risk allocation, and dispute resolution.

Elena also regularly advises airport authorities on legal issues arising from their day-to-day operations and capital development activities.  Her airport law practice encompasses construction and professional services contracting, procurement, leases and other property-related agreements, regulatory compliance, and operational and governance matters.  She also advises airport authorities regarding Federal Aviation Administration requirements and grant assurances, federal contracting requirements, DBE and ACDBE compliance, and legal issues arising from airport development and operations.
